Under the European Communities (Rights Against Insurers) Regulation 2002, the insurers of the driver who is to blame for the accident shall be liable under section 3 of the European Communities (Rights Against Insurers) Regulation 2002.

If you have been involved in a car accident or any other type of road accident and the driver to blame for the accident is insured, you are entitled to issue court proceedings directly against the insurers of the driver who was to blame for the accident or the road traffic accident.  In other words, you can claim compensation directly from the insurers of the driver who caused the accident rather than the driver him or herself.
